Terms of Service
1. Acceptance of Terms
By accessing or using the iuse.page website, mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.
Lightover Inc. ("Lightover," "Company," "we," "us," or "our") operates the Platform. The terms "you" and "your" refer to any individual or entity using the Platform, whether as a user who recommends service providers, a visitor who browses recommendations, or a service provider listed on the Platform.
2. Modifications to Terms
We reserve the right to modify these Terms at any time. For material changes, we will provide notice through the Platform or by email at least thirty (30) days before the changes take effect. For non-material changes, updates become effective upon posting. Your continued use of the Platform after any modification constitutes acceptance of the updated Terms.
3. Description of the Platform
iuse.page is a personal recommendation and introduction platform. Users create pages listing service providers, contractors, and businesses they personally recommend. The Platform may also allow users to post project descriptions so that service providers can reach out to arrange introductions, calls, or meetings.
The Platform is an informational and introductory tool only. We do not employ, contract, vet, certify, endorse, or guarantee any service provider listed on the Platform. We do not facilitate, manage, or process payments between users and service providers. We do not supervise, direct, or control any work performed by service providers.
4. No Endorsement or Guarantee of Service Providers
YOU ACKNOWLEDGE AND AGREE THAT:
(a) Recommendations on the Platform are personal opinions of individual users and do not constitute endorsements, warranties, or guarantees by Lightover Inc.
(b) Lightover does not verify, investigate, screen, background-check, license-check, insure, bond, or otherwise evaluate any service provider listed on the Platform.
(c) Lightover makes no representations or warranties regarding the quality, safety, legality, qualifications, licensing, insurance, reliability, trustworthiness, or competence of any service provider, contractor, or business listed on or introduced through the Platform.
(d) Lightover is not responsible for any work performed (or not performed), damages, injuries, losses, disputes, or claims arising from your interaction with, hiring of, or engagement with any service provider found through the Platform.
(e) You are solely responsible for conducting your own due diligence before hiring or engaging any service provider, including but not limited to verifying licenses, insurance, references, qualifications, and background information.
(f) Any transaction, agreement, or relationship between you and a service provider is strictly between you and that service provider. Lightover is not a party to any such agreement and bears no liability arising from it.
(g) Lightover is not liable for any user-posted content about service providers, including recommendations that may be inaccurate, misleading, or defamatory.
(h) You represent that any services you recommend or solicit through the Platform comply with applicable licensing and regulatory requirements in your jurisdiction.
5. User Responsibilities
5.1 Eligibility
You must be at least 18 years old and capable of entering into a binding legal agreement to use the Platform.
5.2 Account Information
If you create an account, you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
5.3 Accuracy of Recommendations
Users who post recommendations represent and warrant that their recommendations reflect genuine personal experience and honest opinion. You agree not to post false, misleading, defamatory, or fraudulent recommendations. You agree not to post recommendations in exchange for compensation, discounts, or other incentives without clear disclosure.
5.4 Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
- Post content that is defamatory, obscene, threatening, harassing, discriminatory, or otherwise objectionable
- Impersonate any person or entity or misrepresent your affiliation
- Harvest, scrape, or collect personal information from the Platform without authorization
- Interfere with or disrupt the Platform or its infrastructure
- Use automated tools, bots, or scripts to access the Platform without our prior written consent
- Attempt to gain unauthorized access to any part of the Platform
- Use the Platform to spam, solicit, or send unsolicited communications
- Post content that infringes on the intellectual property rights of any third party
- Manipulate or abuse the recommendation or project-posting features for deceptive purposes
6. Service Provider Terms
If you are a service provider listed on or using the Platform:
(a) You acknowledge that any listing does not create an employment, agency, partnership, or joint venture relationship with Lightover.
(b) You are solely responsible for your own conduct, representations, qualifications, licensing, insurance, and quality of work.
(c) You agree not to misrepresent your qualifications, experience, licensing, or insurance status.
(d) Lightover bears no responsibility for ensuring you receive work, referrals, or compensation through the Platform.
7. Projects and Introductions
(a) Lightover merely facilitates introductions and does not participate in, supervise, or guarantee any resulting arrangement.
(b) Lightover is not responsible for the conduct, communications, or reliability of any party introduced through the Platform.
(c) Any scheduling of calls, meetings, or other communications arranged through the Platform is entirely between the parties involved.
8. Intellectual Property
8.1 Platform Content
The Platform, including its design, logos, text, graphics, software, and other content owned by Lightover, is protected by intellectual property laws.
8.2 User Content
You retain ownership of content you post. By posting, you grant Lightover a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your content in connection with operating and promoting the Platform.
8.3 Removal of Content
We reserve the right to remove any User Content at our sole discretion, for any reason, without notice.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimers
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
YOUR USE OF THE PLATFORM AND YOUR RELIANCE ON ANY INFORMATION, RECOMMENDATION, OR INTRODUCTION OBTAINED THROUGH THE PLATFORM IS ENTIRELY AT YOUR OWN RISK.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LIGHTOVER INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL LIGHTOVER'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU PAID TO LIGHTOVER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS LESS.
12. Indemnification
You agree to defend, indemnify, and hold harmless Lightover Inc. from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Platform, your content, your violation of these Terms, or your interaction with any service provider found through the Platform.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at legal@iuse.page and attempt to resolve the dispute informally for at least thirty (30) days.
13.2 Binding Arbitration
If informal resolution is unsuccessful, any dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
13.3 Class Action Waiver
YOU AND LIGHTOVER AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
14. Termination
We may suspend or terminate your access to the Platform at any time, for any reason, without prior notice or liability.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lightover regarding your use of the Platform.
